WEBCITY MARKETING TERMS AND CONDITIONS

  1. - WebCity Marketing normally only accepts orders on official WebCity Marketing order forms, either hardcopy or on-line, and subject to these terms unless expressly agreed otherwise in writing on our own company letterhead.
  2. - Hosting Services and "WebCity Directory" provided by WebCity Marketing are subject to interruption during maintenance and availability is not guaranteed at any particular time.
  3. - Prices quoted for on-going services are quoted at today’s prices. WebCity Marketing may increase charges for such services during the course of the contract.
  4. - WebCity Marketing reserves the right to refuse any advert it deems not suitable. i.e. adult, pornographic or illegal.
  5. - All web sites will be optimised for viewing with Microsoft Internet Explorer (v3 or higher), to be viewed on screen resolution of 800 x 600 in high (16 bit) colour unless stated otherwise in writing. The client accepts that certain features of their site may not work, or may not be visible, or may look different, depending on the functionality of the hardware and software used to view the site. 
  6. - The client must own copyright, or have reproduction rights, of all artwork, trade names, photographs, and other materials supplied to WebCity Marketing for inclusion on the clients web site. The client shall indemnify WebCity Marketing against any costs whatsoever in connection with the ownership of copyright or reproduction rights. The client shall have full liability for the consequences of the contents of their site.
  7. - WebCity Marketing shall own the full copyright of all graphics and text (including html) files created by them.
  8. - Payment for design services -  Failure to pay on time will render the client liable to a charge of 3% of the overdue sums per 30 days or part thereof until payment is received. Late payment of one instalment will render all future payments due under the contract to become immediately due.
  9. - The business of WebCity Marketing may be transferred to a limited company at some time in the future. WebCity Marketing may at any time transfer all assets and/or liabilities they may have under this contract to a limited company, so long as all other assets and liabilities under similar WebCity Marketing partnership contracts are simultaneously transferred to the limited company. After such a transfer, the clients sole remedy shall lie with the limited company.
  10. - Whilst we aim to keep to all promises with regard to time, time shall not be of the essence.
  11. - WebCity Marketing shall not be held responsible for any claims made about a particular product / service / description - before making any payments for any product, item, booking or service it is up to the purchaser to ensure the claims are true. No responsibility will be held by WebCity Marketing.
  12. - Should WebCity Marketing waive any of these terms on an individual basis,  this shall not affect the validity of remaining clauses or commit WebCity Marketing to waive the same clause on any other occasion.
  13. - This contract shall be subject to English Law. Where it is held that WebCity Marketing is not entitled to rely on any term in this contract, then WebCity Marketing may also be allowed to cancel all its rights and obligations under this contract, or to hold all other clauses as valid entirely at their sole discretion
